The UBE is Making its Move!
More States Are Now Implementing the UBE
The American Bar Association ("ABA") has been rumored in recent years to have made some legitimate and substantial requests to various states throughout the country. Firstly, enrollment and acceptance at law schools has shrunk by an average of 20% to as much as 45% depending upon the state and the school.
Secondly, it was rumored that a request for many states to shift over to the UBE was made. For example, the New York bar exam was considered to be one of the more difficult bar exams in the country. New York (and New Jersey among other states) decided to shift over to the UBE. North Carolina, another state that has long been considered as having a difficult bar exam, has shifted over to the UBE as of February 2019. The latest state to make its move to the UBE is Maryland, administering the UBE for the first time in July of 2019. The final surprise is/was the State of Texas, adopting the UBE for the February 2021 examination.
Third, it is thought that law schools in the near future will feature a form of residency, akin to what physicians are required to undertake. Students who graduate from law school know the difference between an offer, acceptance and consideration but lack the skills needed to draft a contract. Students may draft a motion in a legal writing course, but lack the skills needed to argue said motion in court. As such, a residency requirement teaching the skills needed to practice the law is likely to be made a part of law school in the near future.
